If you received direct notice that your Private Information may have been compromised during the targeted cyberattack on Grayback Forestry, Inc.'s (“Grayback”) computer systems that occurred in January 2026 (the “Data Breach”), then you may be a Settlement Class Member. Excluded from the Settlement Class are: (1) Grayback and its officers, directors, and related companies; (2) the Judge in this case, and the Judge’s family and staff; (3) anyone who perpetrated the Data Breach; and (4) anyone who validly excludes themselves from the Settlement.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by December 28, 2026.

Grayback has agreed to pay for a number of Class benefits, which are explained below. All Class Members are eligible to enroll in three years of Credit Monitoring from CyEx Financial Shield Complete, and one or more Cash Payment options.

Credit Monitoring. All Class Members are eligible to enroll in three (3) years of CyEx Financial Shield Complete. Enrollment codes have been sent to all Class Members by postcard. If you no longer have your enrollment code, please contact the Settlement Administrator. Your CyEx Financial Shield Complete subscription will become active once the Court grants Final Approval to this Settlement. This comprehensive service comes with $1 million of financial fraud insurance, and includes monitoring for:

  • fraud or identity theft

  • unauthorized financial transactions

  • personal information associated with high-risk transactions

If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Compensation for Out-of-Pocket Expenses. Class Members who incurred actual, documented out-of-pocket losses due to the Data Breach can get back up to $5,000.00. The losses must have occurred between January 5, 2026, and December 28, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • losses because of identity theft or fraud

  • fees for credit reports, credit monitoring, or freezing and unfreezing your credit

  • cost to replace your IDs

  • postage to contact banks by mail

To be eligible, the losses must satisfy the following requirements:

  • the loss is an actual, documented, and unreimbursed monetary loss

  • the loss was more likely than not caused by the Data Breach

  • the loss was incurred after the date of the Data Breach

  • you made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to seeking reimbursement from available credit monitoring insurance and identity theft insurance

You need to submit proof, like bank statements or receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Breach.

Compensation for Lost Time. Class Members who spent time responding to the Data Breach may claim up to five (5) hours, at $25.00 per hour, for a maximum of $125.00 (combined with Out-of-Pocket Expenses, the combined total is capped at $5,000.00). You must have spent the time on tasks related to the Data Breach. Some examples include things like:

  • changing your passwords

  • investigating suspicious activity in your accounts

  • researching the Data Breach

Alternative Cash Payment. Instead of a payment for Out-of-Pocket Expenses or Lost Time, you may claim a one-time Alternative Cash Payment of $65.00. If you claim the Alternative Cash Payment, you cannot also receive compensation for Out-of-Pocket Expenses or Lost Time.

More information about each of these benefits please review the Notice, FAQs and the Settlement Agreement.
